Resolution No. 2021-11 Abolishing the Village of Reeseville Police Department

RESOLUTION NO. 2021-11

 

A RESOLUTION TO ABOLISH THE VILLAGE OF REESEVILLE POLICE DEPARTMENT AND TO CONTRACT WITH DODGE COUNTY FOR THE PROVISION OF LAW ENFORCEMENT SERVICES

 

WHEREAS, the Village of Reeseville has investigated the issues and ramifications pertaining to the possible dissolution and cessation of its police department, including, but not limited to, the financial, operational and functional aspects, and the level of service and other impacts and factors associated therewith; and

WHEREAS, the Village has investigated and researched the possible contracting of law enforcement services from the Dodge County Sheriff, including, but not limited to, the financial, operational and functional aspects, and the level of service and other impacts and factors associated therewith; and

WHEREAS, representatives of the Dodge County Sheriff’s Department, and other entities and individuals, have made various and numerous presentations to the Village Board and the public in support of the Sheriff’s Department and in support of contracting with the County for the provision of law enforcement services; and

 

WHEREAS, the Village of Reeseville has held numerous informational and discussion meetings open to the public pertaining to the possible dissolution and cessation of its Police Department, and the possible contracting of law enforcement services from the Dodge County Sheriff; and

WHEREAS, the boundaries of the Village of Reeseville are totally included within Dodge County; and

WHEREAS, the Village of Reeseville is authorized to take this action pursuant to Wisconsin Statute Section 62.13(2s).

NOW THEREFORE, IT IS HEREBY RESOLVED, as follows:

1.     That the Village of Reeseville Village Board finds it is in the best interest of the Village of Reeseville to request and contract for law enforcement services from Dodge County.

2.     That the Village of Reeseville hereby requests that Dodge County enter into an agreement under Wisconsin Statute Section 59.03(2)(e), with the Village, pursuant to which the Dodge County Sherriff will provide law enforcement services in all parts of the Village.

3.     That pursuant to Wisconsin Statute Section 62.13(2s)(b), such contracted law enforcement services are to be provided exclusively by Dodge County.

4.     That pursuant to Wisconsin Statute Section 62.13(2s)(c) the agreement to be entered into between the Dodge County and the Village of Reeseville shall, at a minimum, address the following

a.     The division, with Dodge County, of the Village of Reeseville’s assets and liabilities that relate to the Village of Reeseville’s Police Department and the amount that Dodge County will pay, if any, for such assets; and

b.     A description of the level of law enforcement and the number of deputies that Dodge County will provide to the Village of Reeseville and the amount that the Village of Reeseville will pay for the services in excess of the Village of Reeseville’s portion of Dodge County’s law enforcement levy; and

c.     A procedure for the Village of Reeseville to request, or require, that Dodge County provide additional law enforcement services and the cost Dodge County may charge the Village of Reeseville for providing additional services; and

d.     The term of the agreement and procedures for the renewal, extension, or termination of the agreement.

5.     That pursuant to Wisconsin Statute Section 62.13(2s)(d), the agreement entered into between Dodge County and the Village of Reeseville shall not take effect until all of the following occur:

a.     The Dodge County Board approves, under Wisconsin Statute Section 59.03(2)(a), this Resolution; and

b.     Both the Dodge County Board and the Village of Reeseville Village Board approve the agreement; and

c.     The Village of Reeseville and Dodge County have discussed the provision of continued emergency “911” telephone service within the Village of Reeseville.

6.     That upon the agreement between Dodge County and the Village of Reeseville going into effect, including the actual, physical performance of law enforcement services on behalf of the Village of Reeseville by the Dodge County Sheriff’s Department, the Village of Reeseville Police Department shall be abolished and no longer exist.

7.     That the Village of Reeseville staff and administration shall continue to communicate, negotiate and work with the Police Department employees to address any issues or ramifications of this Resolution; to effectuate a smooth transition to the contracted law enforcement services.

 

This Resolution shall be effective upon publication or posting as provided by law.
